Whether it is necessary to issue notice to village panchayat if relief is not claimed against it?

There is also an argument canvassed on behalf of the respondent No. 2 that the notice as required under Section 180 of the Village Panchayat Act, has not been issued in this case before filing of the suit against respondent No. 2. There is no dispute about non-issuance of notice under Section 180 of the said Act, but considering the fact that no relief has been claimed against respondent No. 2, the notice under Section 180 of the said Act would not be required in the instant case. Therefore, argument is rejected.
