Maharashtra amendment regarding Transaction Entered By Family Member Of Govt. Servant




Maharashtra Civil Services (Conduct) (Amendment) Rules, 1998 - r

Insertion of sub-rule (3A) in Rule 19 - In exercise of the powers conferred

by the provisc;>to Article 309 of the Constitution .of India, the Governor of I)

Maharashtra IS hereby pleased to make the following rules further to amend

the Maharashtra Civil Services (Conduct) rules, 1979, namely :-

1. These rules may be called the Maharashtra Civil Services (Conduct)

(Amendment) Rules, 1998. _

2. In rule 19 of the Maharashtra Civil Services (Conduct) Rules, 1979 '-,

after sub-rule (3), the following sub-rule shall be inserted, namely :-

"(3A) Notwithstanding anything contained in sub-rules (2) and (3) any

transaction entered into by the spouse or any other member of family of

Government servant out of his or her own funds (including stridhan gifts,



inheritance, etc.) as distinct from the funds of the Government servant

himself, in his or her name and in his or her own right, shall not be treated as 

a transaction entered into by the member of the family of Government 

servant within the meaning of sub-rules (2) and (3).
