Karnataka HC dismisses contempt plea against its registrar General

BANGALORE: In an interesting case, a division bench headed by Justice K L Manjunath has dismissed a contempt petition filed against B A Patil, registrar general of the high court. 

The bench however, observed that the complainant can revive the petition if the order in writ appeal preferred by the high court ends in his favour. 

The writ appeal filed on behalf of the high court is pending before a division bench headed by Chief Justice. One B S Shivaramaiah, a former court officer had claimed that the top official of high court failed to comply with the direction issued by a single bench on October 9,2103 wherein a direction was issued to treat him as if on duty till superannuation and also pass appropriate orders for according consequential benefits to him within three weeks from the receipt of the copy of the said order. 



The single bench had quashed the enquiry report by the specially empowered authority and also the order rejecting review plea filed by Shivaramaiah . 

The court had held that disciplinary authority has failed to examine all the statements in detail and the reviewing authority also passed a one line order without considering all the facts of the case. 

The single also noted that there was no specific charge or material against Shivaramaiah with regards to alleged receipt/acceptance of bribe money 

B S Shivaramaiah was dismissed from service in October 2010 on the ground that he received a bribe of Rs 15,000 from a person on July 6 2007 through the help of second division assistant of the court for showing official favour. 

Shivaramaiah had claimed that he was on earned leave for considerable period during June-July 2007 , when the alleged incident is said to have taken place and the same fact was not at all taken into consideration by the enquiry officer.
