Muslim widow can go to family court: Bombay high court

MUMBAI: The Bombay high court on Friday ruled that the family court has jurisdiction to hear a widow and her five children's petition for maintenance under the Muslim Personal Law from the heirs of her deceased father-in-law.
Justice Roshan Dalvi heard a petition by the heirs of Alam Khan (name changed) challenging a family court order, which held that it had jurisdiction to hear the maintenance plea of Afsana Begum (name changed) and her children, who had staked claim to her deceased husband's share.
Her husband was the son of Khan's first wife while the petitioners (the heirs) are from his third wife. 
Justice Roshan Dalvi heard a petition by the heirs of Alam Khan (name changed) challenging the February 20, 2012, order of the family court, which held that it has jurisdiction to hear the plea of Afsana Begum (name changed) and her five children for maintenance. Her husband was the son of Khan's first wife while the petitioners (the heirs) are the children of his third wife.
